By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, please do not use our Services.

These Terms form a legally binding agreement between you (“you” or “User”) and Gonzalez Commodity Enterprises, a corporation based in California. We reserve the right to update these Terms at any time, with the “Last Updated” date reflecting changes. We will notify you of material changes via email or a website notice (where feasible). Your continued use of the Services after updates constitutes acceptance of the revised Terms.
2. Eligibility

- Not be prohibited from engaging in commodity trading under applicable laws, including U.S. federal regulations or sanctions lists.

We may refuse service to anyone for any reason, at our sole discretion, subject to applicable law.
3. Services Provided
Gonzalez Commodity Enterprises facilitates trading and brokering of commodities, including but not limited to energy (e.g., oil) and gold, in regulated markets. Our Services may include:
- Matching buyers and sellers for spot trades or futures contracts.
- Providing market data, pricing insights, or transaction support.
- Managing logistics or settlement for commodity transactions.
- Offering account management or text message alerts for appointments and meetings (see Section 8).
Our Services are subject to market conditions, regulatory requirements (e.g., Commodity Futures Trading Commission rules), and availability.
4. User Accounts
To access certain features of our Services, you may need to create an account. You agree to:
- Maintain the confidentiality of your account credentials (e.g., username, password).

- All trades (e.g., oil futures, gold spot purchases) are subject to the terms of specific contracts, exchange rules, and applicable regulations.
- You are responsible for understanding the risks of commodity trading, including price volatility and delivery obligations.
- We act as a broker or intermediary and do not guarantee market outcomes or profits.
b. Payments and Fees
- You agree to pay all fees, commissions, or charges associated with your transactions, as disclosed at the time of trade or in your account agreement.
- Payments must be made in accordance with contract terms, and failure to pay may result in penalties or legal action.
c. Risk Disclosure
Commodity trading involves significant financial risk. Past performance is not indicative of future results. You should consult a financial advisor before engaging in trades.
6. User Conduct
You agree not to:
- Use our Services for illegal purposes, including fraud, money laundering, or violating trade sanctions.
- Interfere with or disrupt our systems, including through hacking or introducing malware.
- Misrepresent your identity, financial status, or trading intentions.
- Use automated tools (e.g., bots) to access our Services without our permission.
Violations may result in account suspension, legal action, or reporting to regulatory authorities.
7. Intellectual Property

We offer optional text message alerts for appointments, meetings, or transaction updates. By opting in, you agree to receive SMS messages from us. Standard message and data rates may apply.
- To Opt In: Text (888) 488-4669 from the phone number you wish to use, or create an account with us using that number and enable text alerts in your account settings.
- To Opt Out: Text STOP to (888) 488-4669 from the enrolled phone number. We will cease sending text alerts to that number upon receipt.
We will not send marketing texts without your additional consent. See our Privacy Policy for details on how we handle your phone number.
9. Privacy
Your use of our Services is also governed by our Privacy Policy, available at www.GonzalezEnterprises.us/privacy-policy/, which details how we collect, use, and protect your personal information. By using our Services, you consent to those practices.
10. Limitation of Liability
To the fullest extent permitted by law:
- Our Services are provided “as is” and “as available,” without warranties of any kind, express or implied (e.g., merchantability, fitness for a particular purpose).
- We are not liable for indirect, incidental, consequential, or punitive damages arising from your use of the Services, including trading losses or market disruptions.
- Our total liability to you will not exceed the fees you paid us in the 12 months prior to the claim.
This does not limit liability for gross negligence or willful misconduct where prohibited by law.

You agree to indemnify, defend, and hold harmless Gonzalez Commodity Enterprises, its affiliates, officers, and employees from any claims, losses, or damages (including legal fees) arising from your use of the Services, violation of these Terms, or infringement of third-party rights.
12. Termination
We may suspend or terminate your access to the Services at our discretion, with or without notice, for reasons including:

- Suspected fraudulent activity.
Upon termination, your account and access will be disabled, but obligations (e.g., payment for completed trades) remain enforceable.
13. Governing Law and Dispute Resolution
These Terms are governed by California law, without regard to conflict of law principles. Any disputes will be resolved as follows:

- Arbitration: If unresolved, disputes will be settled by binding arbitration in Los Angeles, California, under the rules of the American Arbitration Association (AAA). You waive the right to a jury trial or class action.
- Exceptions: Claims for injunctive relief or intellectual property disputes may be brought in state or federal courts in Los Angeles County, California.
14. Force Majeure
We are not liable for delays or failures in performance due to events beyond our control, including market closures, natural disasters, regulatory actions, or technical failures.
